Joy K. Mele is an Associate in the Firm’s Labor and Employee Benefits practice.

Ms. Mele litigates complex matters in federal and state court. Since joining the Firm in 2007, she has been involved in a wide range of cases representing plaintiffs and defendants, involving claims under various federal and state laws. Representative matters include defense of LMRA Section 303 and DFR claims, prosecution and defense of claims under RICO, ERISA, the Fair Labor Standards Act, and federal anti-trust laws. Of particular note, Ms. Mele litigates ERISA fraud actions that seek to hold employers and their principals liable for defrauding funds of required contributions.

Prior to joining O’Dwyer & Bernstien, Ms. Mele had extensive private practice experience litigating Civil Rights and Family Law matters in federal and state courts, including cases involving the illegal removal of children from their homes. In addition, as a Staff Attorney for South Brooklyn Legal Services Corp. in New York City, Ms. Mele provided direct legal representation in Family Law, as well as Housing, Wills, Trusts and Estates, Guardianship, Custody Planning and Public Benefits Law.

While earning her law degree at the City University of New York School of Law, Ms. Mele was the recipient of numerous Fellowships, including the H. Revson Law Students Public Interest Fellowship, Shanara Gilbert Summer Fellowship, and a Haywood Burns Human Rights Fellowship.

Ms. Mele is the co-author of “Child Protective Proceedings: Post Dispositional Considerations” New York Civil Practice: Family Court Proceedings (Matthew Bender & Co., 2004).

Ms. Mele is a member of the New York State Bar Association and New York County Lawyers’ Association.
