Building collapse in midtown kills one worker and injures another

A building located at West 38th Street and 5th Avenue being converted into a luxury hotel collapsed this morning killing one worker and injuring another.

Construction like this is going on all over the City and the workers involved are subject to great risk especially in situations where owners and contractors fail to comply with Federal and State regulations relating to worker safety.

New York State has enacted several laws, particularly Sections 200, 240 and 241(6) of the Labor Law to protect workers from accidents involved in the construction, demolition and/or renovation of buildings.

These laws require the owners and contractors of the sites to provide a safe place to work. Failure to comply with these statutes provides workers with a vehicle to seek substantial damages arising from work related accident.
